Please be aware that any content you share on our Services, including public posts, may be visible to other users and the wider audience, so exercise caution while revealing sensitive information.
- When you make reservations or purchases through our Services, we collect and store information to fulfill your requests. This may include your phone number, address, email, billing information, and credit or payment card details. To process these transactions, we may share this information with third-party service providers, including PCI compliant payment gateway processors, who assist in handling and fulfilling your requests securely. Rest assured, when you provide credit or payment card information, we use industry standard encryption technologies to safeguard the data, ensuring its protection. Additionally, if you write reviews about businesses with which you transact through our Services, we may publicly display the relevant transaction information associated with those businesses to enhance the transparency and credibility of the reviews.
- When you communicate with other users or merchants through our Services, participate in surveys, ratings, reviews, polls, sweepstakes, contests, or promotion schemes, and request certain features like newsletters, updates, or other products, we collect and store the information exchanged during these interactions. - If you request a friend to join and connect with you on the Services under invite/refer a friend feature, we will use your friend’s contact information to process your request.
Information We Collect Through Automatic Data Collection Technologies
We may automatically collect certain information about the computer or devices (including mobile devices) you use to access the Services, and about your use of the Services, even if you use the Services without registering or logging in.
- Personal Information: Details of your use of our Services, including traffic data, timezone, language, location data, logs and other communication data and the resources that you access and use on or through our Services.that also includes Information about your computer, Internet connection and mobile device, including your IP address, operating systems, platforms, browser type, other browsing information (connection, speed, connection type etc.), device type, device’s unique device identifier, mobile network information and the device’s telephone number. Our applications also may access metadata and other information associated with other files stored on your mobile device. This may include, for example, photographs, audio and video clips, personal contacts and address book information.
- Device Information: Unique mobile device identifier (Device token, UDID or other identification information related to device), if you’re using our Services on a mobile device, we may use mobile device IDs (the unique identifier assigned to a device by the manufacturer), instead of cookies, to recognize you. We may do this to store your preferences and track your use of our applications. Unlike cookies, mobile device IDs cannot be deleted. Our advertising devision may use device identifier to track your use of our applications, track the number of advertisements displayed, measure advertising performance and display advertisements that are more relevant to you. Analytics companies may use mobile device IDs to track your usage of our applications.
- Your activity: Information about your activity on the Services, such as your search queries, realtime location as permitted by you, comments, domain names, search results selected, number of clicks, pages viewed and the order of those pages, how long you visited our Services, the date and time you used the Services, error logs, and other similar information.
- Our Applications: If you use the Limerr or its partner’s application, Limerr may collect information about the presence and/ or absence and/ or details pertaining to other applications on your mobile phone. We may also colleact last web pages you visited before visiting our website including duration of online/offline status in application. The applications we gather information for, may vary across categories including, without limitation, shopping, fashion, food and travel. This will help us understand you and your preferences better and enable Limerr to provide you with a personalized experience.
- Your Location: When you use one of our location-enabled services (for example, when you access Services from a mobile device), we may collect and process information about your mobile device’s GPS location (including the latitude, longitude or altitude of your mobile device) and the time the location information is recorded to customize the Services with location-based information and features (for example, to inform you about restaurants in your area or applicable promotions). Some of these services require your personal data for the feature to work and we may associate location data with your device ID and other information we hold about you. We keep this data for no longer than is reasonably necessary for providing services to you. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by disabling the GPS or other location-tracking functions on your device, provided your device allows you to do this. - Partners: We may gather information about you from third parties, such as partners, marketers, third-party websites, and researchers, and combine that information with data we collect from or about you. This allows us to enhance the functionality of our Services, provide personalized experiences, and improve the quality of our offerings. When information is anonymized or de-identified, it no longer contains personal identifiers and cannot be linked back to individual users. Information Shared with Partner businesses like Restaurents
- When you make a restaurant reservation or place an online food order through our Services, we collect your information and share it with the restaurants you choose to reserve. This is done to facilitate your reservation and order processing, similar to how it would be if you made the reservation or order directly with the restaurant.
- If you provide a mobile phone number, the restaurants or Limerr may send you text messages regarding the status of your reservation or food order delivery. Some restaurants may also require you to provide credit or debit card information to secure your reservation.
- When you make a reservation or food order through our Services and make a payment to a restaurant, we may also share additional information with the restaurant. This may include information about your dining preferences, history, or data collected from third parties.
- Please be aware that any information you choose to share with a restaurant during the reservation or payment process may be used by the restaurant for its own purposes. We do not control the privacy practices of restaurants. If you want to learn about the privacy practices of a specific restaurant, please contact them directly.
- To use certain of our Services, such as to make payments to certain restaurants, we may require credit or debit card account information. By submitting your credit or debit card account information through our Services, you expressly consent to the sharing of your information with restaurants, third-party payment processors, and other third-party service providers (including but not limited to vendors who provide fraud detection services to us and other third parties), and you further agree to the following terms:
- When you use a credit or debit card to secure a reservation through our Sites, we provide your credit or debit card account information (including card number and expiration date) to our third-party payment service providers and the applicable restaurant.
- When you initially provide your credit or debit card account information through our Services in order to use our restaurant payment services, we provide your credit or debit card account information to our third-party payment service providers. As explained in our Terms of Use, these third parties may store your credit or debit card account information so you can use our restaurant payment services through our Services in the future.

Merchant Privacy Policy:
1. Ownership: Merchant Data, Customer Data & Intellectual Property
1.1. Ownership of Intellectual Property: The rights, title, interest, copyright, and other worldwide Intellectual Property Rights pertaining to the Hardware, Services, and Professional Services, including all derivatives, updates, modifications, upgrades, enhancements, extensions, or improvements thereof, as well as any new features, functionality, applications, or services provided under this Agreement by or on behalf of Limerr (and/or its licensors), shall unequivocally remain vested in Limerr (and/or its licensors). Merchant is encouraged to provide voluntary Feedback at any time. By doing so, Merchant irrevocably assigns and agrees to assign any and all right, title, interest, and other worldwide Intellectual Property Rights in and to the Feedback to Limerr, Inc. Merchant acknowledges that Limerr has the unrestricted right to use, disclose, reproduce, and exploit any and all Feedback provided by Merchant or any Employee pertaining to the Services, at Limerr’s sole discretion, without any obligation or restriction. All rights not explicitly granted herein are reserved by Limerr.
1.2. Merchant Data and License: Merchant retains ownership of all Merchant Data. In connection with the Services, Merchant grants Limerr a non-exclusive, royalty-free, fully paid up, and worldwide license to use, copy, modify (including creating derivative works), display, and transmit Merchant Data. This license extends to the development of potential offerings or future Services under consideration by Limerr, whether independently developed or through third parties. Merchant is solely responsible for the accuracy, quality, content, and legality (including compliance with Applicable Law and Rules) of Merchant Data, as well as any transfer and use of such data outside of the Services. Merchant represents, warrants, and affirms that it possesses all necessary rights to upload Merchant Data to the Services and to permit its use or sharing by Limerr as needed. Merchant shall not upload or store any data or materials violating the terms of this Section.
1.3. Customer Data: Both Limerr and Merchant will collect, store, and use Customer Data during the provision of Services. If Merchant’s use of Customer Data extends beyond the scope defined in this Agreement or within Limerr’s Privacy Statement, Merchant must establish additional controls (such as notice and consent) and governance for such usage. Each party shall use Customer Data in accordance with Applicable Law and Rules.
1.4. Anonymized and Aggregated Data: Notwithstanding any contrary provision, Limerr has the right to generate anonymized or aggregated data from Merchant Data, Customer Data, and Personal Information. Such data will not identify Merchant, users, Employees, or any other individuals. This anonymized or aggregated data may be used lawfully, including the compilation, distribution, and publication of anonymous statistical or analytical data concerning Hardware or Services performance, development of new Services or Hardware, and other purposes. Upon creation, Limerr shall retain all Intellectual Property Rights in and to such data, without any obligation to Merchant or restrictions.
1.5. Use of Merchant Marks: Merchant grants Limerr a nonexclusive, royalty-free license to use and display Merchant’s Marks on its website, marketing materials, and public disclosures, solely to identify Merchant as a customer of Limerr. Limerr gains no rights to the Merchant Marks beyond this limited use, and Merchant retains full ownership.
2. Data Privacy & Security
2.1. Processing of Personal Information: Both parties acknowledge that the processing of Personal Information belonging to Merchant, Merchant’s Employees, and Customers is an integral part of the Services. For Personal Information processing covered by this Agreement, the provisions outlined in the Merchant Data Processing Addendum are incorporated by reference and form an integral part of this Agreement.
2.2. Roles in Personal Information Processing: In certain instances, Limerr will act as a Processor and process Personal Information on your behalf. This includes the processing of (i) Personal Information of Merchant Employees for services related to Employee management and administration on behalf of the Merchant, and (ii) Personal Information of guests for specific Services allowing the Merchant to directly communicate with and provide offerings to Customers, such as loyalty programs, gift cards, and marketing initiatives. Further details regarding each party’s responsibilities can be found within the Merchant Data Processing Addendum.
2.3. Security Controls and Obligations: Each party is responsible for implementing and maintaining suitable technical, organizational, and administrative security controls to protect Personal Information and other data associated with their respective obligations under this Agreement and the provision of Services. This encompasses measures like access controls and preventing improper disclosure of Personal Information or other data collected as part of the Services. This obligation does not diminish Merchant’s duties in complying with any security measures mandated by Applicable Data Protection Laws.
2.4. Security Incident Management: If either party (directly or through a third party) identifies or becomes aware of a Security Incident, the discovering party shall promptly notify the other party and take necessary actions to address any non-compliance with this Agreement. This includes adhering to the Agreement’s relevant requirements and cooperating with the investigation of the Security Incident. If a Security Incident is attributed to the actions or omissions of the Merchant, the Merchant shall assume all costs related to addressing the incident and fulfilling its legal obligations under the Applicable Data Protection Laws.
2.5. Right to Audit and Cooperation: As part of this Agreement, Limerr reserves the right, with reasonable notice, to conduct an audit of Merchant’s facilities, systems, and personnel to verify compliance with the provisions outlined in this section, especially when there is a reasonable suspicion of a breach or potential breach. The Merchant commits to providing full cooperation to Limerr and its representatives during such audits.
Email/SMS/Push Communication choices
When you sign up for an account, you are choosing to receive emails from Limerr and its restaurant partners’ businesses. You have the option to log in and manage your email preferences, and you can follow the “unsubscribe” instructions in commercial email messages. However, please be aware that you cannot opt out of receiving order status-related communication and certain administrative, service, or legal policy emails from Limerr. These communications are essential for providing you with the best service and keeping you informed about your orders and account activities.
Security: How we protect your information
We have taken appropriate measures to ensure the security of your information and prevent unauthorized access. These measures include physical, electronic, and managerial procedures designed to safeguard your data and consider the sensitivity of the information we collect. We adhere to industry standards to protect personal information during transmission and storage. Our third-party service providers, including payment gateway and processing services, are validated as compliant with the Payment Card Industry Data Security Standard (PCI DSS).
However, we cannot guarantee absolute security, and we are not liable for any disclosure of your information resulting from transmission errors, unauthorized access by third parties, or other unforeseen causes beyond our control. It is important for you to play a role in keeping your personal information secure by not sharing your account user name, password, or other security information with anyone. If we receive instructions using your account credentials, we will assume that you have authorized those instructions.
Accessing & correcting your personal information
We are committed to accurately recording the personal information you provide to us and updating it as needed. We encourage you to review, update, and correct your personal information maintained by us. If any of the information is inaccurate, incomplete, or irrelevant for legitimate purposes, or if it is being processed in violation of applicable legal requirements, you may request that we delete or rectify such information.
